State v. H.C. – DUI Marijuana

A State Patrol officer arrested H.C. on New Year's Eve in Gwinnett County for Driving Under the Influence of Marijuana.  After pulling H.C. over for speeding the trooper smelled a strong odor of marijuana from H.C.'s car.  H.C. agreed to perform field sobriety evaluations.  Although the tests that the trooper performed on H.C. have not reached a state of “verifiable scientific certainty” to be admitted into evidence at trial, and Mr. Ryczek convinced the prosecutor to dismiss the DUI drugs charge, and H.C. entered a guilty plea to Reckless Driving.
