Georgia DUI Laws
What you should know about a DUI
Please use the tabs on the left of your screen to familiarize yourself with the license and criminal penalties associated with your particular circumstances. It is important to know that the law enhances the mandatory minimum license suspensions depending on how many prior offenses you have in the previous five years from date of arrest to date of arrest.
Mandatory minimum penalties are determined by utilizing a ten-year look back period. For example, you face enhanced criminal penalties under the law when you receive two DUI convictions within ten years, but you do not face those enhanced minimum penalties when you receive two DUI convictions eleven years apart. However, prosecutors will generally recommend and judges will generally sentence multiple offenders to enhanced criminal penalties regardless of whether they fit within the ten-year window.
