State v. R.S. –DUI and Improper Lane Change
A Gwinnett County Police officer arrested R.S. for DUI after finding him in his car, stuck in a ditch. R.S. had taken a turn too quickly and lost control of his car. The officer smelled a strong odor of alcohol and noticed other manifestations of intoxication. In a Gwinnett Recorder's Court bench trial (before a judge instead of a jury) Mr. Ryczek argued that the evidence did not rise to the level of “beyond a reasonable doubt” and the judge agreed. She found R.S. not guilty of Driving Under the Influence.
