State v. S.A. – Refusal

S.A. was pulled over on Cumberland Boulevard for driving with no headlights after midnight.  After the officer blue-lighted S.A. she continued to drive for several hundred yards.  When she finally pulled over, the officer noticed a strong odor of alcohol on her breath, and she gave inconsistent statements about how much alcohol she drank.  She showed almost all the clues on field sobriety evaluations, and refused the Intoxilyzer 5000 test.  Although two separate officers claimed that a video did not exist in S.A.'s case, Mr. Ryczek proved using the open records act that both officers had video cameras in their cars and that neither officer requested repairs on the cameras.  Using this information, Mr. Ryczek convinced the prosecutor to reduce the case to Reckless Driving.
