B.S. was drunk and sleeping in the parking lot of Jeffery's, a local sports bar.  A City of Braselton police officer approached an arrested B.S.  He was obviously intoxicated, however there was no evidence of B.S. having driven his car while impaired.  Mr. Ryczek made that argument to the judge, and the judge found B.S. not guilty of DUI.
