State v. J.T. – Refusal

J.T. was arrested by the Gwinnett County DUI Task Force after he allegedly cut off several cars upon turning left onto Beaver Ruin Road.  J.T. appeared to fail the field sobriety evaluations on the video.  However, upon closer examination of the video, it appeared that J.T.'s manifestations of intoxication were more consistent with someone who was having a panic attack.  Through cross-examination, Mr. Ryczek exposed inconsistencies in the officer's statements, and argued to the jury that the State failed to prove J.T.'s guilt beyond a reasonable doubt, as J.T.'s manifestations could have been caused by J.T.'s anxiety.  The jury found J.T. not guilty of DUI, Improper Starting, and Improper Left Turn.
